AGREEMENT OVERVIEW: This agreement expresses the full and complete agreement between the named parties (hereafter referred to as ATHLETE) and Candace Nicole Photography, LLC (hereafter referred to as CNP) regarding the subject matter hereof. It supersedes all prior agreements. The only way to add or change this agreement is to do so in writing.

HOUSE RULES: ATHLETE agrees and understands that the photographer(s) are limited by the guidelines of the training facility or site/venue management and ATHLETE agrees to accept the results that may occur from said guidelines. All training facility workers, site/venue management, meet directors, officials refereeing and overseeing all event activities, are NOT liable for any photographic outcome, completion time or delivery.

IMAGES AND COPYRIGHTS: Photographs/images produced by CNP are protected by Federal Copyright Law (all rights reserved). Upon final payment by ATHLETE, ATHLETE is granted limited license to use and display resulting images for personal use. Said images may not be altered or reproduced in any manner without prior written permission of CNP. The expecting ATHLETE who receives high-resolution digital images with printing rights, who may make prints for personal use, as indicated on user license, but may not copy, or re distribute the images in any manner. The ATHLETE must obtain written permission from, and compensate CNP prior to the ATHLETE, its associates, friends or relatives publishing or selling the photographs.

USAGE RELEASE: The ATHLETE hereby grants to CNP and successors, heirs, executors, administrators, assigns, attorneys, representatives and agents, the irrevocable and unrestricted right to use and publish photographs of the ATHLETE or in which the ATHLETE may be included, for editorial, trade, advertising or any other purpose and in any manner or medium; to alter the same without restriction; and to copyright the same. The ATHLETE hereby releases CNP and all associates, representatives and assigns from any and all claims, actions, demands, suits, liabilities, damages, expenses and obligations of any kind arising from, or related in any manner to CNP use of said images.

RETAINING FEE: Payment is due in full at time of booking. This is a NON-REFUNDABLE FEE. Should ATHLETE cancel or otherwise breach this agreement, the payment shall be liquidated for damages to CNP.

LIMIT OF LIABILITY: In the unlikely event that the photographer(s) are injured, become too ill, or has an emergency that prevents them from photographing the event, CNP will make every effort to secure a replacement photographer. If a suitable replacement is not found, ATHLETE agrees that responsibility and liability of CNP to the ATHLETE is limited to the return of all payments received for the event. CNP takes the utmost care with respect to exposure, storage and processing the photographs/images, but cannot and does not, guarantee that photographs/images of the event will not be lost, stolen or destroyed for reasons within or beyond CNP's control. ATHLETE agrees that CNP or the photographer(s) full and complete responsibility and liability is limited to the return of all payments received for the event. ATHLETE further agrees that the limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the estimated percentage of the total number of original images.

COMPLETION SCHEDULE & PHOTO DELIVERY: ALL final images are selected by CNP and at CNP's discretion. ATHLETE will receive a minimum of 20 images. All final edited, high resolution images will be delivered in an online gallery with full viewing, download, sharing and printing capabilities. The gallery will remain active for 1 year and is backed up to the cloud for easy back up. No RAW images will be delivered to ATHLETE. All Images are expected to be prepared for viewing within the online gallery 7-10 business days following event.

CREDIT : A credit line should be included with each photo that reads "Photos: © Candace Nicole Photography, LLC". For Social Media use, ATHLETE will note attribution to the photographer and a tag @CandaceGotLifts or @CandaceNicolePhotos

IMAGE RELEASE: Candace Nicole Photography, LLC gives permission to ATHLETE to reproduce images for any personal or non-profit projects such as video, film, social media, electronic media, or personal prints. The images may be backed up or archived as necessary to complete the above stated uses only. You may not use, or allow anyone to use, any of the photos to create pornographic, libelous, obscene, fraudulent, illegal, or defamatory material.
